Terms and Conditions for content sharing

We really love seeing our products being used by our customers and would like to be able to share this on our websites, social media accounts or other forms (hereinafter referred to as “Accounts”). To do this, we need you! You have been transferred here because we really like your content and we (vidaXL and its affiliate companies (hereinafter ‘vidaXL’)) noticed you used one of the following content sharing options to provide consent for vidaXL to use the content (hereinafter referred to as “Work”).

We would like to share your Work on our websites, Accounts or otherwise as explained herein. To this end, we are obtaining your explicit consent to make use of the requested Work as follows:

1. Ways to share content with us

There are three ways for you to share content with us:

Direct Message (DM)	If you use another hashtag linked to vidaXL (e.g., #vidaXL, #vidaXLnl), we may contact you via DM to request consent.	A button will be provided in the message to confirm or decline consent.
Website Upload	Submit your content via the dedicated Work form on vidaXL’s website.	Upon submitting the Work form on our website, you grant consent automatically

2. Eligibility

By sharing your Work with us using any of the methods described in article 1 of the present, you confirm that you are:

- A natural person of legal age;
- The user, owner, tenant or any other title that entitles you to authorize the transfer; and,
- The original author and owner of the work you have shared.

3. License Grant

By sharing your Work with us using any of the methods described in article 1 of the present, , you agree to these Terms and Conditions and grant vidaXL a license that is:

- Free of charge, waiving any right to receive compensation;
- Non-exclusive, allowing you to use and license the Work elsewhere;
- Territorially unrestricted, applying worldwide;
- Perpetual, lasting indefinitely until consent withdrawal (see Part 7);
- Transferable and sublicensable, enabling vidaXL to authorize use by third parties.

The license allows vidaXL to:

a) Use, reproduce, distribute, publicly display, publicly perform and exhibit the Work on our websites, Accounts, and other media, including newsletters and print material;
b) Authorize others to perform the above activities on behalf of vidaXL;
c) Modify, edit, translate, store and create derivative works of the Work without further consent.

Uses for which and third parties with whom your Work may be shared include: social media (amongst which are Instagram, Facebook, Twitter, Pinterest and TikTok), advertising third parties (Google adds, agencies for advertising, etc.), third party sales channels (Amazon eBay, etc.), brick-and mortar shops, our newsletter or as printed advertising on folders.

4. Third-Party Rights and liability

4.1 Third-Party Rights and liability

vidaXL will take reasonable action to address any copyright or rights violations if reported. However, by sharing your Work with us using any of the methods described in article 1 of the present, you confirm that the Work does not breach any third-party rights, including personality or privacy rights. We kindly request that you refrain from submitting pictures depicting individuals as any such Work will not be used. vidaXL will, however, not be held liable for any breach of the assurances provided under Section 2 to 4.

4.2 Images, Persons, and Personal Data.

You must ensure that your submitted Work does not depict any persons (whether recognizable or not and does not contain any personal data, such as full names, ID numbers, license plates, addresses, telephone numbers, or any other identifying information. By submitting, you confirm that no persons or personal data are visible. vidaXL reserves the right to reject or cease use of any Work that includes persons or personal data.

5. Personal data and consent withdrawal

For crediting purposes, we may process personal data such as your username on the platform from which you use the hashtag and published the Work. In exceptional cases, additional data (e.g., your email or other data provided to us) may be processed. You retain the right to:

- Request access, rectification, or deletion of your personal data;
- Withdraw consent at any time as specified in section 7 below.

6. Credit for your work

Where possible, we will credit your Work by tagging your username or mentioning your name. However, specific formats or placement cannot be guaranteed.

7. Consent withdrawal and content removal

If you choose to withdraw your consent, notify us by sending an email to [email protected]. Upon withdrawal, vidaXL will cease using your Work for the future from receipt of your request or at least within 30 days from your request. Content already published will be removed unless impossible or unreasonable (examples include printed out material from past promotions).

8. Intellectual Property Rights

You acknowledge that the vidaXL site, social media accounts, trademarks, and logos are protected by intellectual property law. This agreement does not grant you any rights over vidaXL’s intellectual property.

9. Amendments and governing law

Any amendments to this agreement must be in written or electronic form. Should any provision be deemed invalid, the remaining provisions will remain effective. This agreement is governed by the laws of the Netherlands.
